Arguing the case, advocates V R Bajwa and Sumeer Sodhi stated that Dr. Divyakirti's remarks were made in a closed environment, thereby not constituting defamation. They emphasized that he was exercising his fundamental right to free expression. The high court's stay reflects a recognition of these arguments.
