A court in Maharashtra's Thane district has sentenced two men to 10 years of rigorous imprisonment in a case involving the rape of a 13-year-old girl in 2018. The accused, Akshay Pandurang Gavate, 27, and Devidas Dharmesh Gavate, 29, were found guilty under the Protection of Children from Sexual Offences (POCSO) Act.
The court also imposed a fine of Rs 15,000 on each of the convicts. Two other accused, juveniles at the time, are undergoing separate trials. The survivor's initial account was consistent, but she later retracted her statement during a re-cross-examination.
Despite this, the court relied on her original testimony, citing medical evidence that supported it, and suggested the retraction might have been influenced. The case highlights the complexities of seeking justice in sensitive legal matters.
