A Thane court has delivered a verdict in a high-profile case involving the death of Anand Kardak, leading to the conviction of his brother, Mahendra Sadashiv Kardak, an auto-rickshaw driver. The court sentenced Mahendra to five years of rigorous imprisonment for culpable homicide not bearing the element of murder.
The incident occurred in 2021 over a property-related dispute at Wagle Estate in Maharashtra's Thane city, during which Mahendra stabbed his brother and injured his other brother's wife with a kitchen knife. The court ruled out premeditated intent, attributing the act to a sudden provocation and heat of passion.
While Mahendra was convicted under IPC section 304 part II, the court acquitted him of attempted murder under section 307, due to insufficient evidence. The imposed fine of Rs 1 lakh is directed to be handed over to the deceased's immediate legal heir.
