The Punjab and Haryana High Court has dismissed Bollywood actor-turned-politician Kangana Ranaut's plea seeking to quash a defamation complaint filed against her by Mahinder Kaur. The complaint stemmed from a tweet by Ranaut during the 2020-21 farmers' protests which allegedly misidentified Kaur and defamed her.
Kaur, a 73-year-old protestor from Bahadurgarh Jandian village, filed the complaint after Ranaut's tweet compared her to a prominent figure from the Shaheen Bagh protests. The Bathinda court summoned Ranaut citing false and defamatory comments dented Kaur's reputation, which Ranaut sought to quash under Section 482 of the Cr.P.C.
In dismissing Ranaut's petition, Justice Tribhuvan Dahiya upheld the Bathinda court's jurisdiction, emphasizing the Magistrate's application of mind based on prima facie evidence under Section 499 IPC. The court stated that the absence of a Twitter report does not undermine the complaint's legitimacy nor the judicial process implemented.
