The Supreme Court on Friday intervened in a contentious case involving a rape accused, putting a stay on an earlier directive that required his wife to remain in India if he were to travel overseas for work.
A bench, comprising Justices Sanjay Kumar and Satish Chandra Sharma, addressed the appeal of a software engineer accused of rape who challenged the Rajasthan High Court's order. The directive, argued his defense, unjustly restrained his wife, who was unconnected to the case.
The top court shifted the requirements, allowing the husband conditional foreign travel upon depositing Rs 2 lakh as surety, while questioning the legality and procedural correctness of the high court's earlier ruling.
