In a pivotal decision, Srinagar's Chief Judicial Magistrate, Aadil Mushtaq Ahmad, denied bail to eight police officers accused of custodial torture against a fellow constable, Khursheed Ahmed Chowhan, in 2023.
The officers, including Deputy Superintendent Aijaz Ahmad Naik and Inspector Riyaz Ahmad Mir, sought bail following their arrest under a Supreme Court order, with allegations brought forth by the Central Bureau of Investigation (CBI).
The magistrate cited the severity of the charges and the lack of exceptional circumstances, emphasizing the necessity of custodial supervision to prevent interference, thus restricting the court's capacity to grant bail during the investigation phase.
