Adani Wins Jaiprakash Associates Bid: Vedanta's Appeal Rejected
The National Company Law Appellate Tribunal upheld Adani Group's Rs 14,535 crore bid for Jaiprakash Associates Ltd, rejecting Vedanta's appeal. Vedanta claimed its offer was superior, but the tribunal supported the Committee of Creditors' decision based on commercial wisdom. The ruling paves the way for Adani's takeover unless challenged further in the Supreme Court.
The National Company Law Appellate Tribunal (NCLAT) has dismissed an appeal by Vedanta Ltd, contesting the approval of Adani Group's Rs 14,535 crore bid for the bankrupt Jaiprakash Associates Ltd (JAL). This ruling follows the Committee of Creditors' (CoC) preference for Adani's proposal, which the NCLT had sanctioned earlier.
Vedanta had challenged the bidding outcome, asserting that its revised bid offered more value. However, the NCLAT ruled that the CoC acted within its commercial discretion, evaluating factors beyond mere bid value. The decision also reflected compliance with the Insolvency and Bankruptcy Code regulations.
This verdict enables Adani's acquisition of JAL's assets, including India's only Formula One circuit, unless Vedanta decides to appeal to the Supreme Court. The NCLAT reiterated that Vedanta's appeal lacked merit, upholding the creditors' judgment in selecting Adani's bid.
