Asterix's Ally Obelix Wins Legal Shield in Trademark Battle
Europe's top court overturned EUIPO's decision allowing a Polish company to use 'Obelix' as a trademark for weapons. The ruling favored Les Editions Albert Rene, publishers of Asterix comic series, emphasizing the importance of recognizing artistic work and protecting the trademark's reputation.
In a significant legal development, Europe's top court has overturned a decision by the European Union Intellectual Property Office (EUIPO) that allowed a Polish entrepreneur to trademark the name 'Obelix' for weapons across Europe. The ruling reaffirms the importance of preserving the artistic legacy.
The dispute began in 2022 when the EUIPO registered 'Obelix' as a trademark for firearms, sparking resistance from Les Editions Albert Rene. They argued that the registration damaged the reputation of their famous earlier EU trademark linked to the beloved Asterix & Obelix comic series.
The Luxembourg-based Court of Justice acknowledged this, denouncing EUIPO's analysis as flawed and incomplete. The court's decision is hailed by the publishing house as a victory for artists, underlining society's responsibility to honor and protect creative work and intellectual property.
