Delhi Court Upholds Personal Liberty in Cheating Case Bail Decision

A Delhi court emphasized the importance of personal liberty as a fundamental right while granting bail to Aneel Kapoor in a cheating case. The court underscored that such liberty should be curtailed only under imperative circumstances, as noted in a Supreme Court judgment.

Additional Sessions Judge Vishal Pahuja considered the case, where Kapoor, accused of visa-related fraud against a senior citizen, argued that the charges arose from a civil dispute. The court noted the allegations involved minor offences with less than seven years of imprisonment.

The judge pointed out that evidence was primarily documentary, involving email exchanges regarding services provided by Kapoor. It also highlighted Kapoor's senior status, permanent residence, and his willingness to assist in the investigation.

The court granted bail on the condition of Kapoor's cooperation with the investigation, requiring a personal bond of Rs 20,000 and forbidding contact with the complainant.
