Bombay High Court Stands Firm: Illegality in School Construction Unforgivable

The Bombay High Court rejected a Pune school's plea to regularise its unauthorised construction, citing the inherent incurability of illegality. Aryan World School had sought relief, arguing it served 2,000 students and possessed a gram panchayat-issued NOC. The court emphasised equal application of the law and urged action against the gram panchayat.

In a recent ruling, the Bombay High Court dismissed the appeal of a Pune-based school seeking to retain an illegal structure on its premises. The court underscored the non-negotiable nature of legal adherence, stating that no concession could be made on account of the school's size or service to students.

The Aryan World School faced a demolition order from the Pune Metropolitan Development Authority for its unauthorised building. The school's defense was based on a 2007 gram panchayat no objection certificate, which the court ruled invalid, pointing out that the proper authority for such permissions is the district collector.

The judgment further tasked the Maharashtra government with holding the gram panchayat accountable for improperly issued NOCs, stressing that such practices, if left unchecked, could undermine town planning laws. A compliance report is to be submitted by November 14.
