The Delhi High Court has deferred its decision on the bail plea of Athar Khan, who stands accused in the 2020 Delhi Riots conspiracy under the Unlawful Activities (Prevention) Act (UAPA). A decision was awaited following submissions from Khan's counsel and counterarguments by the Delhi Police.
Athar Khan's defense, led by Advocate Arjun Diwan, pointed to inconsistencies in the testimony of witness Pluto, who initially implicated Khan in the conspiracy discussions but altered his statement within days. The defense underscored the absence of evidence indicating Khan's active participation, highlighting that conversations in Khan's seized WhatsApp chats revolved around peaceful protests.
Despite these arguments, Special Public Prosecutor Madhukar Pandey opposed Khan's bail, contrasting it with other granted bails, such as Gulfisha Fatima's. Pandey emphasized that evidence, including witness statements and chats suggesting violent intentions, substantiates charges against Khan. The trial court continues hearings on charge framing against Khan and other co-accused. (ANI)
