A recent ruling by the Motor Accident Claims Tribunal (MACT) in Maharashtra's Thane district has resulted in a compensation award of Rs 22.3 lakh to five family members injured in a 2018 accident.
The tribunal held the car owner and the insurer, HDFC ERGO General Insurance Co Ltd, responsible, noting the accident was due to the car driver's negligence; he held only a two-wheeler license.
The insurance company contested the claim, citing policy breach, but the tribunal directed the insurer to pay first and recover the amount from the driver later.
