The Supreme Court has expressed disapproval of the Bombay High Court's decision to halt a tribunal's directive for a ₹256.45 crore refund to a firm, asserting that high courts are not 'custodians' of the revenue department.
A bench comprising Justices Ujjal Bhuyan and Manmohan highlighted that the high court overstepped by issuing a stay despite deeming the revenue department's appeal non-maintainable.
The Supreme Court stayed the June 12 high court order, while directing the revenue department to respond to the firm's plea and scheduling further hearings for July 2.
