A Delhi court has reversed a previous ruling directing four journalists to delete allegedly defamatory articles targeting Adani Enterprises Limited (AEL). Judge Ashish Aggarwal emphasized that the original order's sweeping effect was akin to ruling on the suit without a trial.
The court demanded a fresh order after hearing both the reporters and AEL. This decision stems from a plea filed by journalists Ravi Nair, Abir Dasgupta, Ayaskanta Das, and Ayush Joshi against a prior restraint from publishing or sharing unverified claims against AEL. The court found the initial order unsustainable due to lack of plaintiff hearing.
The court underscored the potential violation of the freedom of speech and expression, stipulating that without prima facie evidence of defamation, the articles should remain accessible to the public. Additionally, the court highlighted procedural lapses in civil court proceedings, advocating for a fair hearing before any interim decisions.
