The government's recent ordinance marks a significant change in the judiciary landscape, expanding the Supreme Court's sanctioned strength from 34 to 38 judges, including the Chief Justice of India. This amendment to the 1956 Supreme Court (Number of Judges) Act was officially notified by the law ministry on Saturday.
This increase comes at a crucial time as the top court faces two vacancies. The ordinance mandates the Supreme Court Collegium to recommend six names for immediate appointment. While this move takes immediate effect, the government plans to introduce a bill in the upcoming Monsoon Session of Parliament to convert this ordinance into a law.
The history of the Supreme Court's expansion reflects periodical amendments, with the strength last being increased from 30 to 33 judges in 2019. The process involves consulting key ministries, including the finance ministry, and requires a draft bill to be moved by the Department of Justice to the Cabinet.
