Supreme Court Overturns Penalty on Amazon, Cancels Future Coupons Deal Suspension

The Supreme Court has relieved Amazon by overturning a penalty of Rs 202 crore and a suspension of its deal with Future Coupons Pvt Ltd. This decision nullifies the previous ruling by the National Company Law Appellate Tribunal (NCLAT), which had dismissed Amazon's appeal regarding an anti-trust decision.

The bench, comprising Justices Vikram Nath and Sandeep Mehta, emphasized the importance of fairness and consistency in regulatory actions. Acknowledging the global economic climate's demand for reliability, the court highlighted the need for equality in treatment of both domestic and foreign market participants. The ruling underlines a fair regulatory framework as being fundamental to maintaining confidence and fostering compliance.

The Competition Commission of India's (CCI) December 2021 decision was set aside, with specific instructions to refund any amount collected from Amazon within eight weeks.
