In a significant ruling, the Supreme Court on Friday directed the Central government to refrain from relieving a group of Army officers. This order follows a plea contesting the early termination of a woman officer, Lt. Col. Geeta Sharma. The bench, led by Justice Surya Kant, highlighted the necessity of maintaining high morale among military personnel, especially during times of conflict.
Justice Surya Kant emphasized the importance of having the officers on the battlefield rather than confined to courtrooms. The discussion unfolded amidst a plea where Lt. Col. Sharma claimed her service was prematurely terminated, prompting her appeal to the top court for intervention.
Senior Advocate Maneka Guruswamy, representing Sharma, cited a previous successful plea by Colonel Sophia Qureshi, which affirmed the Court's stance against systemic gender discrimination within the army ranks. Guruswamy remarked on the critical nature of allowing competent officers to continue to serve, a sentiment echoed by Justice Surya Kant.
Despite opposition from Additional Solicitor General Bhati, representing the Centre, the Court mandated that officers not be discharged until further hearings, scheduled for August 6 and 7. The decision underscores the judiciary's commitment to ensuring that military personnel remain focused on national security rather than legal disputes.
