The Delhi High Court has refused anticipatory bail to Jagdish Das, a goldsmith, in a case involving the alleged misappropriation of gold meant for jewellery making. The Economic Offence Wing (EOW) registered a First Information Report (FIR) in 2022, and a non-bailable warrant was issued as Das had not cooperated with the investigation.
Justice Ravinder Dudeja cited the cumulative circumstances in denying the bail plea, emphasizing that anticipatory bail is not typically granted to individuals declared as proclaimed offenders under Section 82 of the Criminal Procedure Code, except in extraordinary situations. The court observed that this case did not qualify as such.
The case revolves around allegations by Taj Exports, which bought 26 kilograms of 24-karat gold from Yes Bank. The gold was provided to Jagdish Das, Director of M/s Jewels Creation Private Limited, for crafting jewellery. However, Das is accused of failing to return or account for all the gold given to him.
