In the unfolding investigation of the Dhaula Kuan BMW accident, accused Gaganpreet Kaur has tested negative for alcohol, contrary to initial suspicions, the Delhi Police revealed on Tuesday. Kaur, responsible for a fatal crash that claimed one life and injured another, was subjected to a medical examination before being arrested and sent to Tihar Jail for two days of judicial custody.
Advocate Vikas Pahwa, representing Kaur, criticized the First Information Report (FIR) for alleged discrepancies against public statements by the Deputy Commissioner of Police. Pahwa stated that the FIR was suspiciously filed ten hours post-incident, and its contents appear to conflict with official press releases, questioning its validity.
Pahwa further contends that the alleged rash and negligent driving charges are unjustified. He argues that applying Section 304 of the Indian Penal Code, intended for culpable homicide, doesn't align with the accident's nature. He emphasized discrepancies in how the accident occurred, based on CCTV evidence, and disputed claims of negligence due to the immediate medical response initiated by the accused.
