During the 10th All India Conference of the Central Administrative Tribunal, Chief Justice of India BR Gavai addressed the distinctive role of administrative tribunals, which sit between the executive and judiciary. He pointed out that many members have an administrative background, while others bring judicial experience, creating a unique dynamic.
Chief Justice Gavai emphasized the importance of diversity within tribunals but acknowledged the need for legal training for members from administrative services. He noted these members often hesitate to issue orders against the government, underscoring the need for consistent training to ensure standards of judicial reasoning.
Additionally, CJI Gavai advocated for the role of workshops and training sessions, led by judicial academicians, in enhancing tribunal effectiveness. Union Law Minister Arjun Ram Meghwal also called attention to challenges facing the CAT, stressing the importance of addressing technological changes and ensuring robust discussions during the conference.
