A software engineer accused of rape has petitioned the Supreme Court against a Rajasthan High Court order that requires his wife to remain in India if he wants to travel abroad for work. His plea claims this directive circumvents procedural protocols and violates fundamental rights.
The plea, filed by advocate Ashwani Dubey, contends that neither the software engineer's wife, who is employed in the US, nor her representation were considered in the decision that insists she stay in the country, despite her absence in the criminal case. The matter is set for an August 8 hearing.
Accused of using the promise of marriage to deceive the woman, the accused was granted anticipatory bail but faced restrictions on his foreign travel. The trial court's denial prompted the appeal, leading to a condition-laden high court approval that he now challenges.
