Patanjali Ayurved filed an appeal in the Delhi High Court challenging a restraining order against its advertisements allegedly targeting Dabur Chyawanprash. The bench of Justices C Hari Shankar and Om Prakash Shukla suggested the ads insinuated generic disparagement, specifically pointing to phrases like 'ordinary chyawanprash made with 40 herbs.'
The court questioned the purpose of the appeal, warning of penalties for what it considered 'luxury litigation.' Patanjali's ads implied that other manufacturers, including Dabur, lacked the knowledge of Ayurvedic practices necessary to produce quality chyawanprash, according to a previous single judge's order.
Scheduled for further hearing on September 23, the case arose after a single judge issued an interim injunction in response to a petition from Dabur, highlighting what it perceived as false claims in Patanjali's advertising. The court demanded modifications to the ad material to eliminate the perceived disparagement.
