The Supreme Court has emphasized that higher academic degrees alone cannot compensate for the lack of required experience in recruitment processes. In a decision on Monday, the court critiqued the Himachal Pradesh Board of School Education for inadequately considering essential qualifications for a computer hardware engineer position.
Justices J K Maheshwari and A S Chandurkar noted that the chosen candidate possessed an M.Tech degree but lacked the stipulated experience, bringing attention to the flawed adherence to the Recruitment and Promotion (R&P) Rules. The court highlighted the fundamental difference between essential and preferential qualifications that was overlooked in the selection process.
The bench underlined the necessity for clear entitlement before appointment, cautioning against decisions that do not arise directly from the rules. The judgment serves as a reminder of the court's role in ensuring procedural fairness and upholding rule-based selections in public employment.
