The Allahabad High Court has highlighted a concerning trend where consensual relationships souring are being legally pursued as rape cases. The court has urged not to trivialize the crime, as these incidents can dilute the gravity of actual misconduct.

In a noteworthy decision, the court dismissed the criminal proceedings against a Gorakhpur individual accused of rape due to a breached promise of marriage. Justice Vivek Kumar Singh pointed out that prolonged consensual relationships turning bitter must not indiscriminately invoke criminal law, as this can result in unjust legal misuse.

The court maintained that marriage promises should only be equated with rape if it is clear that there was never any intention of commitment from the outset. This decision came following a complaint where the prosecutrix alleged false marriage promises, leading to intimate relations that turned acrimonious when the accused ultimately refused to marry her.
