Allahabad High Court Dismisses Rape Charges Stemming From Failed Marriage Promises

In a significant ruling, the Allahabad High Court has expressed concern over a rising pattern where consensual relationships deteriorating into accusations of rape. The court emphasized the importance of not trivializing the serious crime of rape, noting potential misuse of legal provisions in such contexts.

Justice Vivek Kumar Singh quashed the charges against Sanjay, also known as Sanjay Kashyap, who was accused of rape on the grounds of a broken marriage promise in Gorakhpur. According to the court, cases where long-standing consensual relationships sour should not lead to criminal charges unless there is evidence of premeditated deceit at the outset.

The decision detailed that not every unfulfilled promise of marriage should be equated with an intention of deceit necessitating rape charges. The case originated from a FIR filed in late March 2024 where the complainant alleged an initial promise of marriage led to their intimate relationship, which later soured when the accused withdrew the offer of marriage.
