Artificial intelligence is rapidly transforming the way decisions are made in public and private sectors, from predictive policing and credit scoring to healthcare diagnostics and job recruitment. However, according to a new study titled “Algorithmic Bias as a Core Legal Dilemma in the Age of Artificial Intelligence: Conceptual Basis and the Current State of Regulation”, published in Laws (Volume 14, Issue 3, June 2025), algorithmic bias has emerged as a fundamental legal and ethical problem that current regulations are failing to address.
The study dissects the conceptual underpinnings of algorithmic bias and argues that its growing presence in AI systems undermines fundamental principles of justice, equality, and legal predictability. Unlike traditional human bias, which can be attributed and challenged through legal norms, algorithmic bias is often embedded deep within data training sets and machine learning architectures. The study emphasizes that this lack of procedural clarity constitutes a threat to rule-of-law principles and judicial fairness.
What are the proposed legal reforms and policy solutions?
In response to these challenges, the study offers a framework for reform aimed at embedding algorithmic accountability into both national and supranational legal systems. It advocates for the establishment of a harmonized legal definition of algorithmic bias that encompasses direct, indirect, and systemic discrimination caused by machine learning systems. This definition would form the foundation for enforceable anti-bias obligations in AI deployment.
The authors recommend a multi-tiered approach to regulation that includes pre-deployment bias audits, real-time monitoring tools, and mandatory post-deployment impact assessments. These tools would be overseen by independent supervisory bodies with technical expertise, empowered to suspend or sanction non-compliant AI systems.
Another key proposal is the introduction of a reverse burden of proof in algorithmic discrimination cases. This would shift the obligation onto organizations deploying AI to demonstrate that their systems are fair and non-discriminatory. Such a shift would significantly reduce barriers for individuals seeking redress and bring algorithmic systems in line with broader principles of administrative accountability.
The paper also calls for public sector leadership in setting standards. Government agencies and courts using AI should adhere to strict procurement guidelines requiring fairness-by-design and explainability. Public interest algorithms, such as those used in welfare or criminal justice systems, should be subject to democratic oversight, including input from civil society, ethicists, and affected communities.
On a broader policy level, the study urges the integration of AI ethics into legal education and public administration. Without legal professionals trained in AI systems and their societal implications, enforcement of new regulations will remain inconsistent and reactive. The paper stresses that legal systems must evolve in tandem with technological advancements to uphold fundamental rights.
