The Delhi High Court has issued an order restraining various businesses from the unauthorized use of Dhanuka Agritech Ltd's trademark, 'DHANUKA'. Justice Tejas Karia granted an interim stay effective until January 29th, based on a plea from Dhanuka Agritech seeking a permanent injunction against Agrim Wholesale Pvt Ltd and others.
The court acknowledged Dhanuka Agritech's established reputation, long-standing use of its marks, and robust compliance in the agrochemical field. The judge pointed out the company's significant market presence with its four ISO-certified facilities and over Rs 2,035 crore in revenue for FY 2024-25, highlighting its credibility among farmers and distributors.
A noteworthy point in the court's deliberation was the defendants' failure to comply with existing rules by selling products using Dhanuka's name without valid licenses, leading to market confusion. With infractions noted even by government advisories, the judge underscored the defendants' continued statutory breaches, necessitating this legal clampdown.
