Allahabad High Court Declares Protection for Lawyers in Legal Duties

The Allahabad High Court has issued a ruling emphasizing that legal professionals cannot be criminally prosecuted for actions executed as part of their professional responsibilities. The court stressed that implicating lawyers in criminal cases for advocating on behalf of clients would undermine the legal profession.

The bench, composed of Justices J J Munir and Tarun Saxena, quashed proceedings against lawyer Samarpan Jain, who was accused in a GST-related conspiracy. The judgment warned that such actions could erode trust in the legal system and impede citizens' right to legal representation.

This case originated from Jain's role in filing appeals against GST assessment orders, utilizing available tax credits for mandatory pre-deposits, a method disputed by GST authorities. The court highlighted that providing legal advice should not be equated with criminal intent.

The judgement underscored the need to uphold the independence of the Bar and maintain the public's access to justice, reinforcing that professional actions taken by lawyers on behalf of clients should not be criminalized.
