Controversy Surrounds Dhaula Kuan BMW Accident Case

The Dhaula Kuan BMW accident case has taken a controversial turn with the accused, Gaganpreet Kaur, testing negative for alcohol consumption, according to Delhi Police on Tuesday. Kaur was subjected to a medical examination to ascertain if alcohol was a factor during the tragic incident that resulted in one fatality and another injury.

Advocate Vikas Pahwa, representing Kaur, raised serious concerns about the First Information Report (FIR) filed in connection with the case. He alleged discrepancies between the FIR and statements made by the Deputy Commissioner of Police (DCP) during a press briefing. Pahwa highlighted the ten-hour delay in filing the FIR and questioned its accuracy, stating, "The information contradicts the DCP's press conference... It appears incorrect."

Pahwa further argued against the application of culpable homicide charges, contending that the accident should only attract charges for rash and negligent driving, a bailable offense under the Indian Penal Code. Citing CCTV evidence and the unfolding of events, he challenged the narrative of a non-bailable offense and underscored the need for accurate judicial proceedings.
